1. About These Terms
By accessing our website, purchasing any product, or booking any service offered through The Listening Counselor ("we," "us," or "our"), you ("Client" or "you") agree to be bound by these Terms and Conditions. Please read them carefully before completing any purchase or booking.
If you do not agree to these terms, please do not use our services or purchase our products.
2. About Our Services
The Listening Counselor offers parent coaching services and educational products, including but not limited to:
• Digital Ebook: I'm Here, With an EAR
• The HEAR Method™ — On-Demand Pre-Recorded Class
• Parent Group Coaching Program
• 1:1 Parent Coaching Sessions
All services are provided by Irene Hernandez, Licensed Clinical Psychologist. However, all services and products offered through The Listening Counselor are strictly coaching and educational in nature and do not constitute psychotherapy, psychological treatment, mental health treatment, or any form of clinical or therapeutic intervention.
3. Not Therapy — Important Disclaimer
The services and products provided by The Listening Counselor are coaching and educational services ONLY. They are not a substitute for professional mental health care, psychotherapy, medical advice, or psychological treatment.
By purchasing or using any of our services, you acknowledge and agree that:
• No therapist-client or psychologist-client relationship is created through any of our services or products.
• Coaching is not therapy and does not diagnose, treat, or cure any mental health condition.
• If you or your child are experiencing a mental health crisis or require clinical treatment, you are strongly encouraged to seek the services of a licensed mental health professional in your jurisdiction.
• The Listening Counselor is not responsible for any outcomes related to your personal or parenting decisions made as a result of coaching or educational content.
4. Eligibility
Our services are available to adults (18 years and older) worldwide. By purchasing or booking, you confirm that you are at least 18 years of age. Our programs are designed for parents and caregivers and are not intended for minors.
5. License and Usage
All digital products purchased through The Listening Counselor — including the Ebook (I'm Here, With an EAR) and The HEAR Method™ On-Demand Class — are for your personal, non-commercial use only.
You may not copy, resell, redistribute, share, or reproduce any part of this content — including the HEAR Method™ and R.U.R.E.R. framework — without written permission from Irene Hernandez / The Listening Counselor.
6. Payment
All prices are listed in US Dollars (USD) and are due in full at the time of purchase or booking. Payments are processed securely through our payment system. We do not store your payment information.
7. Refund Policy
Digital Products (Ebook & On-Demand Class)
Due to the instant, digital nature of these products, all sales are final. No refunds, exchanges, or cancellations will be provided once purchase is completed, as the product is immediately accessible upon payment.
Coaching Programs (1:1 and Group)
Sessions must be cancelled or rescheduled at least 24 hours in advance. Cancellations with less than 24 hours notice may be forfeited without refund. No-shows will be charged in full.
Group program sessions are non-refundable once the program has begun. If you are unable to attend a scheduled group session, a session recording or summary may be provided at our discretion.
8. Scheduling & Availability
1:1 coaching sessions are scheduled by mutual agreement based on both the client's and the coach's availability. The Listening Counselor will make reasonable efforts to accommodate your schedule but cannot guarantee specific times.
Group programs run on set dates announced in advance. By enrolling, you agree to the published schedule. Dates are subject to change with reasonable notice.
9. Intellectual Property
All content, materials, methods, and frameworks offered through The Listening Counselor — including but not limited to the HEAR Method™, R.U.R.E.R. framework, ebooks, class recordings, worksheets, and website content — are the exclusive intellectual property of Irene Hernandez / The Listening Counselor and are protected by copyright.
You may not reproduce, distribute, share, resell, or create derivative works from any of our materials without express written permission. The HEAR Method™ is a registered trademark and may not be used without authorization.
10. Confidentiality
We respect your privacy and the personal information you share in coaching sessions. Information shared in 1:1 sessions is kept confidential, except in the following circumstances:
• Where disclosure is required by law.
• Where there is a risk of imminent harm to you or others.
• Where you have given explicit written consent for disclosure.
Please note that group sessions are not confidential in the same way as 1:1 sessions. By participating in a group program, you agree to maintain the confidentiality of what other participants share within the group.
11. Limitation of Liability
All services and products are provided "as is." While all content is based on clinical experience and professional training, outcomes from applying coaching strategies or educational content may vary by family and individual circumstances.
To the fullest extent permitted by applicable law, The Listening Counselor and Irene Hernandez shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our services or products, including but not limited to decisions made as a result of coaching, outcomes in your parenting or family relationships, or technical issues with digital products.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid for the specific product or service giving rise to the claim.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of El Salvador, without regard to conflict of law principles. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of El Salvador.
Clients outside El Salvador acknowledge that by purchasing our services, they agree to El Salvador as the governing jurisdiction.
13. Changes to These Terms
We reserve the right to update or modify these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Your continued use of our services after any changes constitutes acceptance of the revised terms.
